Terms of Service
Carefully read these Terms of Service (henceforth “terms”, “the Agreement”) before sending a commission inquiry. By requesting a quote, the client (“you”) acknowledges they have agreed to the terms outlined here by the artist, Julien Agreste (“eorapture”, “I/me”) regardless if they have read them or not.
These terms are subject to revisions at any time without notice. Changes will not be applied retroactively. If you have any questions or wish to inquire about rates, please contact me directly via email (vireosy+nsfw@gmail.com).

General
- Clients must be 18 years or older to purchase artwork from me. Minors are strictly prohibited from participating in any eorapture project.
- The artist reserves the right to decline or terminate a commission for any reason.
- Prices are subject to change. Clients will not be billed nor reimbursed the difference if the cost of an item changes during a project’s duration.
- The client understands that they are paying for the non-refundable time and expertise of an artist. Completed commissions are not eligible for refund.
- The artist staunchly refuses to work with any imagery or client that espouses white nationalism, LGBT-phobia, ableism, anti-choice rhetoric, anti-vaccination rhetoric, willful ignorance of the climate crisis, pro-cop and military propaganda, or eco-fascism.
Communication & Delivery
- Project discussion and other business-related inquiries should be conducted via email.
- Emails are handled on business days (Monday through Friday). I do not have open business hours on weekends and will not respond until Monday at the earliest. I may require one to two business days to respond.
- The artist expects the client to respond to commission updates in a timely manner. I will not continue working on a commission while it is awaiting approval.
- Pending approval, the final work is sent via email and provided as a PNG at 300dpi with a non-obtrusive artist’s signature somewhere along the piece. A web version (at lower resolution and watermarked) is also provided for posting publicly online.
- Upon delivery, it is the client’s responsibility to store their commission properly. Loss of product due to negligence will not be reimbursed by the artist. I cannot guarantee that an original copy of the commission will be available in the event that you lose the file(s).
Workflow
- The artist typically sends Work in Progress updates (“WIPs”) at various stages for client approval throughout the project’s duration. The client may receive one to three WIPs for a single piece. These can vary depending on the style of commission.
- The Estimated Turnaround Time (“ETA”) is exclusively an estimate and is not a guarantee for a project’s completion.
- It is the client’s responsibility to provide accurate references for the artist. Please understand that colours may be adjusted from reference image(s), sometimes heavily so, depending on context. If exact colours must be used, note this in advance.
- Clients are encouraged to request edits (colour adjustments, small fixes, markings, artist errors, etc.) at any point, including after completion. Major edits at any point after inking may incur a fee.
- Clients are welcome to reach out via email at any point to inquire about the status of their commission.
- If a client requires their project for a specific deadline, it is their responsibility to inform the artist prior to invoicing. Please note: not all deadlines can be accommodated. Rush fees may apply.
- If the artist cannot meet a prescribed deadline, whether owing to illness, technical issues, extenuating circumstances, or otherwise, they will inform the client posthaste. An alternate deadline may be proposed or the project terminated and a refund issued.
Payment
- Invoices are due within 14 days of issue.
- Client may request a payment plan or extension on their invoice due date. Payment plans will only be discussed for projects above $100 USD.
- Invoices are issued via Artistree and may be processed through PayPal or Stripe, with Stripe as the default. You don’t need an account with Artistree or Stripe to receive or pay an invoice.
- The artist doesn’t accept payment in cryptocurrencies. This includes but is not limited to Bitcoin (BTC), Ether (ETH), Dogecoin (DOGE), and USD Coin (USDC). Any payments found originating on chain will be refunded, the project terminated, and the client barred from future correspondence.
- If a refund is issued, the amount may vary depending on the amount of work completed at the time of issue.
- To start, the artist will retain 15% the amount paid as a courtesy charge, plus an equivalent percentage determined by progress made.
- A full refund may be issued for a project terminated by the artist if no work has been done.
Rights Granted
- The artist retains full copyright on the commissioned work. Completed client work may be used for my own advertising and self promotion purposes. All client work is published to my online galleries and social media at my discretion.
- Clients may request to keep their commission private. This must be noted prior to completion. Private commissions will not be used for advertising, nor will they appear in my online galleries or social media.
- The work is to be accepted as-is. The client is free to make minor edits such as cropping the work or adding simple borders, but you may not alter the artwork itself without my permission.
- The client may publish their commissioned work to their own social media and online galleries provided the artist is given appropriate attribution.
- The client may use their commissioned work for personal, noncommercial use such as social media banners, icons, wallpapers, or physical art prints where no monetization or profit is being made.
- Under no circumstances is any of the artist’s work, whether personal or commercial, to be minted on chain as a non-fungible token (“NFT”). Clients who circumvent this article immediately relinquish their rights to the image and will be barred from future correspondence. Further, the artist forbids the use of their art in any future blockchain technologies.
- The artist’s work cannot be used in a generative artificial intelligence (“AI”) training database nor altered with the use of AI.
Cancellations & Scrapped Projects
- Both the client and artist reserve the right to cancel the commission at any point, and a partial to full refund will be issued. Refund amounts may vary, determined by the amount of work done at the time of issue.
- The client loses all rights to the work if a commission is terminated. This includes any WIPs or finished work I may have provided.
- If a commission was abandoned or cancelled while incomplete, it may be repurposed or resold by the artist. The client’s character(s) will be removed and replaced.
- Scrapped WIPs may be repurposed or resold by the artist. The client’s character(s) will be removed and replaced.
